Given that the US Federal Government can't hold a copyright for any work it produces, does it make sense to use an open-source license, or should items be released explicitly unlicensed and into the public domain? Should code be released under a different license than data?

Edit:
I should mention I am asking this as an employee of the federal government, looking for opinion and/or external legal interpretation.
